WHO IS RESPONSIBLE FOR YOUR PERSONAL DATA

For the purposes of applicable data protection laws and regulations (the General Data Protection Regulation (EU) 2016/679 (“GDPR”) and the implementing Greek law 4624/2019)), your data will be controlled by Legal Capital.

 

PERSONAL DATA WE COLLECT

We collect and process all or part of the following personal data about you:

 

  • identity and contact data (e.g. name, address, telephone number, date of birth, passport number, employment history, educational or professional background, tax status, job title and function etc.), and other personal data concerning your preferences relevant to our services;

 

  • financial and payment data and other related billing information, including your bank account and other data necessary for processing payments and for fraud prevention;

 

  • business related information, including information provided in the course of our contractual relationship or otherwise voluntarily provided by you or your organization;

 

  • personal data relevant to any dispute, litigation, arbitration including information relevant to legal advice we have been asked to provide to our client;

 

  • profile and usage data, including your communication preferences and information about how you use our Website, including the services you viewed or searched for, page response times, download errors, length of visits and page interaction information (such as scrolling, clicks, and mouse-overs).   • sensitive personal data: In the course of our services, we may represent you and/or your organization in legal cases requiring us to collect and use sensitive personal information relating to you (e.g. physical or mental health, or details of criminal offences). For example, in life insurance disputes data such as information about medical conditions may be relevant to the representation. Where we process sensitive personal information in the course of our services, we do so to assist you and/or your organization to establish, exercise or defend legal claims.

 

  • information about other people. If you provide information to Legal Capital about any person other than yourself, your employees, counterparties, your advisers or your suppliers, you must ensure that they understand how their information will be used, and that they have given their permission for you to disclose it to us and for you to allow us to use it.

 

HOW WE COLLECT YOUR PERSONAL DATA

We may collect your personal data:

 

  • when you or your organization seek legal advice from us;
  • when you or your organization offers to provide, or provides, services to us;
  • when provided to us by a third party because you are the subject of, or your data is otherwise included in, legal advice we are asked to provide to that third-party / client (e.g. where we are asked to provide advice in a dispute)
  • when you correspond with us by phone, email or other electronic means, or in writing, or when you provide other information directly to us; 
  • when you or your organization browse, complete a form or make an enquiry or otherwise interact with the Website;
  • when you attend our events;
  • by third party sources such as government agencies, credit reporting agencies, information service providers or from publicly available sources.

 

IF YOU DO NOT PROVIDE NECESSARY PERSONAL DATA

If we need to collect personal data by law or in order to process your instructions or to perform a contract passed with you or a legal action agreed with you and you do not provide necessary data as appropriate, we may be unable to carry out your instructions or to perform the relevant contract or action agreed with you. In this case, we may have to cancel our engagement or contract, but we will notify you timely should this be the case.

 

HOW WE USE YOUR PERSONAL DATA

We use your personal data only for the following purposes:

 

  • to fulfil a contract, or take steps linked to a contract, with you or your organization;
  • as required by Legal Capital to conduct our business and pursue our legitimate interests; or 
  • as required by law, including maintaining records, compliance checks or screening and recording (e.g. anti-money laundering laws, tax laws etc.). 

We will not use your personal data for taking any automated decisions affecting or creating profiles other than as described above.

 

DISCLOSURE OF YOUR PERSONAL DATA

We share your personal data, in the following circumstances:

 

  • with third parties, including certain service providers we have retained in connection with the legal services we provide, such as bailiffs, lawyers, mediators, or experts and other legal specialists such as law firms for obtaining specialist or foreign legal advice, translators, education evaluation services, couriers, or other necessary entities;

 

  • with courts of law, law enforcement authorities, regulators, government officials or lawyers or other parties where it is reasonably necessary for the establishment, exercise or defense of a legal claim, or for the purposes of an alternative dispute resolution process;

 

  • with service providers who we engage to process personal data for any of the purposes listed above on our behalf and in accordance with our instructions;

 

  • if we sell or buy any business or assets, in which case we may disclose your personal data to the prospective seller or buyer of such business or assets to whom we assign or novate any of our rights and obligations.

 

  • if the disclosure is necessary for Legal Capital to comply with applicable law and/or to assess or defend legal claims.

 

INFORMATION WE MAY TRANSFER

If we transfer your data outside Greece, we will safeguard that information as described in this Privacy Notice. To provide legal service we may transfer data we collect to countries outside of the European Economic Area which do not provide the same level of data protection as Greece or the country of your residence does and are not recognized by the European Commission as providing an adequate level of personal data protection. We will only transfer personal information to any such other country, only if necessary, for the services we provide you, or, for the establishment or defense of legal claims always subject to safeguards that assure the protection of your data (European Commission approved standard contractual clauses).

 

UPDATING YOUR PERSONAL DATA

If any of the personal data you have provided us changes or if you become aware of us having any inaccurate personal data about you, please let us know by sending an email to privacy@legalcapital.gr. We will not be responsible for any losses arising from any inaccurate, inauthentic, deficient or incomplete personal data that you provide us.


YOUR RIGHTS

Right of Access: you have the right to request copy of your personal data we hold. Such access could be denied in exceptional cases (e.g. if it is legally forbidden to Legal Capital to disclose such information).

 

Right to Rectification: we aim to keep your personal data complete and accurate. We encourage you to contact us to let us know if any of your personal data is not accurate or changes, so that we can keep your personal data up-to-date.

 

Right to Restriction of Processing:  you have the right to ask us to restrict your personal data if such data is not processed for purposes of legal compliance. If you would like us to restrict use of your personal data, please contact us at privacy@legalcapital.gr

 

Right to Data Portability: you have the right to request that some of your personal data is provided to you, or to another data controller, in a commonly used, machine-readable format.

 

Right to Erasure: you have the right to ask us to erase your personal data when the personal data is no longer necessary for the purposes for which it was collected, or when, among other things, your personal data is no longer necessary to be kept by us in accordance with applicable laws and regulations.

 

Right to Withdraw your consent: in case where the processing of your personal data is based exclusively on your consent, you have the right to withdraw your consent at any time and without any detriment. We will take all reasonable steps to make the requested changes promptly. However, you should be aware that it may not be technologically possible to change or delete all your data from our systems, and personal data might remain in non-erasable forms. We may retain personal data in our backup systems for the period defined by law, contract or audit requirements.

If you believe that your data protection rights may have been breached by Legal Capital, you have the right to file a complaint with the applicable supervisory authority, or to seek a remedy through the courts. HOW LONG WE KEEP YOUR PERSONAL DATA

We will keep your personal data for as long as necessary to fulfil the purposes for the collection, the purposes of satisfying any legal, accounting, tax, or reporting requirements and, where required for Legal Capital to assert or defend against legal claims, until the end of the relevant retention period or until the claims in question have been definitively settled.

 

CHANGES TO THIS PRIVACY NOTICE
